Sentence of the Court in case C-224/00, 19 March 2002. The Court condemned the regulations of the Italian highway code that establish a discrimination based on citizenship. The Commission had proposed taking legal action against the Italian Republic since some regulations of the new Italian highway code entail a discriminatory treatment depending on the place where a vehicle was registered. In the view of the Court, the demand that an offender, who is a citizen of another member state of the EU, pay a surety is not per se censurable. But it is necessary that the sum of the said surety should not discriminate him in comparison with the treatment reserved for national citizens.
