SIR EUROPA: CZECH BISHOPS CONFERENCE ON THE SENTENCE OF THE CONSTITUTIONAL COURT

The Czech Bishops Conference, in a release published on 13th November, expresses its disagreement with the decision taken by the Constitutional Court of the Czech Republic, of rejecting the proposal submitted by the Christian-Democratic senators to amend Act 495/2005. In the release, the Bishops Conference explains that the purpose of Act 495 was to impose limits to the Churches and religious communities as legal persons if they found charity organisations or schools within the ecclesiastic facilities. Basically – explains the Bishops Conference –, all the institutions founded by the Churches are legally bound to go through "an extremely complicated legal procedure" that, according to the bishops and the other Christian Churches, is "unfair". However – explains the spokesman of the Bishops Conference, father Juan Provecho –, it is an "open sentence", since the Court itself asserts "the need of respecting religious freedom". Now the bishops – says father Provecho – are busy "carefully studying all the over 90 pages of documents". The Conference will ask the Court to give effective directions on how to construe Act 495, "without causing any disadvantage to the Churches and religious communities". If such directions "impair the action of the Churches – says father Provecho –, we are prepared to appeal to the European Court".
